L’Oreal Trims Claims in Suit Targeting PFAS Presence in Mascara

"L’Oreal USA Inc. saw the dismissal of a handful of plaintiffs and state-law claims in a proposed class action alleging it failed to tell consumers its waterproof mascaras contained PFAS chemicals.

Six named plaintiffs failed to adequately allege they overpaid for the mascaras because they didn’t say when they bought the mascaras, the US District Court for the Southern District of New York said Thursday. Without the purchase date, these plaintiffs couldn’t show temporal proximity to when the products were tested for perfluoroalkyl and polyfluoroalkyl substances, Judge John P. Cronan said."
